Understand, our police officers put their lives on the line for us every single day. They've got a tough job to do to maintain public safety and hold accountable those who break the law. It is because i agree with Barack Obama, the 44th president of the United States, in the position that police risk their lives to protect us and we ought to let them, that i feel compelled to negate today's resolution. Resolved: The United States ought to limit qualified immunity for police officers. For clarification of today’s round i offer the following definitions. Ought: Used to express obligation Limit: a point beyond which is not possible to go Qualified Immunity:immunity from civil liability that is conditioned or limited Police officers: a person whose job is to enforce laws, investigate crimes, and make arrests a person whose job is to enforce laws, investigate crimes, and make arrests The highest value within today's round is safety. Safety is defined as being free from the occurrence or risk of injury, danger, or loss. Safety is the highest value in today’s round because without the safety of our police, we would be open to danger. The best value for evaluating today’s resolution is utility. Utility is defined as promoting the greatest happiness of the greatest number of persons.(if they ask to put it in your own words, say benefiting the majority) It best achieves my value of safety because if the police are allowed to protect us, the greatest amount of good is being done for the greatest amount of people. In negating the resolution, I offer the following contentions: Contention 1: The police protect us, and we should protect them in court. Contention 2: Qualified Immunity is already denied to immoral police officers. Contention 1: The police risk their lives to keep us safe from many people and things, such as serial killers. If the police had more limited qualified immunity, citizens could sue them more, and keep them from protecting us, because the officer would have to go to court, and their time would be consumed by the lawsuit. (impact) It would be unwise to not give them qualified immunity so they can continue to protect us. Contention 2: There are many cases where police, who were morally wrong, try to get qualified immunity, such as Mullenix V Luna (info from law.cornell.edu), and failed to do so. The police officer, Chadrin Mullenix, shot at Isreal Leija Jr six times with a rifle. Isreal was pronounced dead after. The police officer should’ve waited and let other officers attempt to stop Isreal by using road spikes, and Justice Sotomayor would agree. The officer was denied qualified immunity, so he could be sued him for actions. (impact) If immoral police officers are unable to get qualified immunity in court, then we shouldn’t reform it to do something it’s already doing. I have shown you that the police protect us, and we should protect them in court, and and qualified immunity is already denied to immoral police officers. For these reasons we can clearly conclude that safety should be upheld, and the United States ought not to limit qualified immunity for police officers.
