“Justice is meant to be blind” has been an opinion shared by many well-meaning people in the past, but in recent times, as we as a society have developed, this model of justice has changed. Justice is not meant to be blind. Firstly, we cannot hold everyone accountable for the same behaviour. A toddler who steals a piece of jewellery from a store should not be held to the same standard and degree of punishment as an adult who does the same thing. For instance, in the United States, people have been given the death penalty who have developmental disabilities and who are minors. Secondly, for some communities such as people with disabilities, equal is not about being blindly treated the same, but about being treated differently. For example, people who use wheelchairs need a ramp to get into a building. Thirdly, we have learned over time that just declaring or acknowledging equality is not enough to erase the effect of decades and even centuries of inequality. We need positive measures, and taking into account people’s situation is necessary for those to happen. Examples of this are affirmative action in education and employment.
